Is poker illegal? Gambling? (legal view)

Poker is growing in popularity in Brazil, and we hear more and more people asking these questions.

“But isn’t it illegal?!

“Isn’t poker a game of chance?”

The (il)legality of poker.

As an official expert report from the São Paulo Criminalistics Institute clearly explains, poker is a random game and does not depend exclusively on luck, only on the distribution of the cards. From then on, bets are made on the real or fictitious value of the cards. Reality or fiction depends on the player's skill, especially as an observer of the opponent's behavior, sometimes quite sophisticated, extracting information from it that leads him to conclude whether or not the opponent is bluffing.

It is no coincidence that poker players are often said to be bluffers. In turn, this opponent may be adopting certain patterns of behavior, but in a cunning manner, that is, in order to bluff as well. For example, when he is doing well, he may appear insecure so that his opponent will increase the bet, or when he is doing badly, he may appear confident and sure so that his opponent will fold. In short, it is a game of mathematics and behavioral psychology.

Thus, in principle, it cannot be considered a game of chance, and therefore a crime, as understood as “the game in which winning and losing depend exclusively or mainly on luck” (DL 3.688/41, art. 50, “a”). In fact, there are poker championships.

Betting games – cash games

A possible problem, in this case, at least at this moment, is of a different nature, it concerns betting, cash games, not tournaments where the player pays a certain amount (entry) and receives a symbolic number of chips, with the one who accumulates all of them by the end of the tournament being crowned champion, receiving a cash prize, or any other material good.

From a legal perspective, gambling, and therefore a crime, is “a game in which winnings and losses depend exclusively or mainly on luck” (DL 3.688/41, art. 50, “a”). Therefore, the meaning of the Law cannot be reversed, interpreting it as gambling when winnings and losses do not depend exclusively or mainly on skill. It is the opposite. What cannot prevail is the luck factor, and not the skill factor, that is, all games or sports in which the skill factor outweighs the luck factor are not considered gambling by law, and are therefore permitted.

Regarding illegal bets, article 814 of the Civil Code states: “Debts from gambling or betting do not require payment; however, the amount voluntarily paid cannot be recovered, unless it was won through fraud, or if the loser is a minor or interdicted. § 1º – (…). § 2º – The provision contained in this article applies, even in the case of non-prohibited gambling, except for legally permitted games and bets. § 3º – Prizes offered or promised to the winner in competitions of a sporting, intellectual or artistic nature are also excluded, provided that the interested parties submit to the legal and regulatory provisions.”

Firstly, the law does not require the loser to pay the bet when it is illegal gambling. However, if someone gambled for money, lost, and paid the lost amount, they cannot seek legal recourse to the Judiciary to seek the refund of the lost amount. The law makes a reservation that allows the amount lost and paid to be recovered in court when the loss is caused by fraud, that is, when the winner uses deceitful means to win, popularly saying, cheating in the game. Another reservation is made by the law that allows the loser to recover the money paid. This is the case of minors and interdicted persons, understood as interdicted persons who do not have full civil capacity, that is, the insane and those declared by court order. Note that §3 of the legal article cited above does not consider as prohibited the prizes offered to winners of competitions, such as poker tournaments.

Illegal poker?

Having made these clarifications, it is therefore necessary to distinguish between prohibited gambling, non-prohibited gambling and legally permitted gambling. Betting is only permitted in legally permitted games, such as lotteries in general. Considering that poker is not a prohibited game because it is not a game of chance, and considering that it is also not legally permitted, that is to say, there is no law that authorizes it, as there is in relation to the various lotteries, it is a non-prohibited game; therefore, betting, gambling for money, is prohibited, and here is the problem. What is prohibited is the betting, not the gambling. This is a case of illegal betting, that is, onerous betting between the players, not illegal gambling.

Thus, it is concluded that everything that is not legally prohibited is permitted. If there is no law prohibiting poker in Brazil, since it is not considered a game of chance, since it depends more on the player's skill than on luck, it is said that it is a game that is not prohibited. The crux of the matter is here, the game for money, not the tournaments, but rather the poker tables where the bets are loose, you can lose R$ 10,000.00 in a single round, while in the tournament, you paid the entry fee and are looking for a final prize, but your loss is conditioned on the value of the entry fee.

And at this point, it is important to emphasize that the prohibition of gambling is not due to fear of ruin for the players, but rather the impossibility of the Government to monitor the winnings obtained in such games, the fiscal purpose of the prohibition, the lack of control structure. Unlike tournaments where monitoring is easier, since the value of the final prize and who the winners are literally known.

I don't believe there will be a ban on poker tournaments, but Poker Associations that allow cash bets within their headquarters should be careful, as they may be breaking the law.

As for online betting, the doubt remains.

Update (2024): Brazil has approved a law that legalizes sports betting and casino games, without mentioning poker directly. This is still a matter of discussion, but the trend is that online poker will be considered legal, since even casinos have been authorized.

      The following are considered games of chance:
      a) the game in which gain and loss depend exclusively or mainly on luck;
      b) bets on horse racing outside a racecourse or a place where they are authorized;
      c) bets on any other sporting competition.

      Gambling is not illegal. What is illegal is to exploit gambling. Gambling can only be exploited with government authorization. Logically, playing with friends without exploiting gambling, that is, without charging commissions, is not illegal.
